2. Services

Ensignis Digital provides IT consulting, cloud solutions, custom software development, cybersecurity services, data analytics, managed IT support, and digital products including but not limited to EnvrTrack (mobile application) and Rainfall API. Details of specific engagements are governed by separate Statements of Work or Service Agreements entered into between Ensignis Digital and the client.

3. Accounts & Access

Where account creation is required to access our products or services, you are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised access at [email protected].

4. Payments & Billing

Fees for our services and products are as agreed in your service agreement or as displayed at the point of purchase. All payments are processed securely through our authorised payment gateway partners. Prices are exclusive of applicable taxes (including GST) unless stated otherwise. We reserve the right to modify pricing with reasonable prior notice.

5. Refunds & Cancellations

Refund and cancellation terms are governed by our Refund Policy, which forms an integral part of these Terms. Please review it carefully before making a purchase.

6. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, icons, and software, is the property of Ensignis Digital Pvt. Ltd. and is protected under applicable Indian and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our explicit written consent.

Custom software developed for clients shall be governed by the intellectual property provisions in the applicable project agreement.

7. Acceptable Use

You agree not to:

• Use our services for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorised access to our systems or other users' accounts
• Transmit malware, viruses, or any harmful code through our platforms
• Misrepresent your identity or affiliation
• Engage in reverse engineering, decompilation, or disassembly of our software products
• Resell or sublicense our services without prior written authorisation

8. Limitation of Liability

To the maximum extent permitted by law, Ensignis Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our services. Our total aggregate liability shall not exceed the amount paid by you to us in the three (3) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Ensignis Digital, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your violation of these Terms or misuse of our services.

10. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our services will be uninterrupted, error-free, or completely secure.

11. Termination

We reserve the right to suspend or terminate your access to our services at our discretion, with or without notice, if we believe you have violated these Terms or engaged in fraudulent or harmful behaviour. Upon termination, your right to use our services ceases immediately.

12. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.

13. Changes to Terms

We reserve the right to modify these Terms at any time. The revised Terms will be posted on this page with an updated effective date. Your continued use of our services after such changes constitutes acceptance of the revised Terms.
